General terms and conditions of business
for the use of the padel court of TSV Battenberg 1912 e.V.
This translation is provided for convenience only. In the event of any discrepancy or conflict between this English version and the German original, the German version shall prevail and be the sole legally binding version.

§ 1 Scope and contractual partners
(1) These General Terms and Conditions (hereinafter “Terms and Conditions”) apply to all contracts for the paid use of the padel court that are concluded via the online booking platform at https://tsv-battenberg-padel.de.
(2) The contractual partner is TSV Battenberg 1912 e.V., Birkenstraße 11, 35088 Battenberg (Eder), registered in the association register of the Marburg district court under VR 3516, represented by the board according to § 26 BGB (hereinafter “association”).
(3) User within the meaning of these General Terms and Conditions is the person who makes the booking. She is a contractual partner of the club and is liable for compliance with these terms and conditions by all players and accompanying persons she brings with her.
(4) Deviating or supplementary conditions of the user do not become part of the contract unless the association expressly agrees to their validity in text form.
(5) The version of these General Terms and Conditions valid at the time of the respective booking is decisive. The user can access, print and save the terms and conditions during the booking process.
§ 2 Conclusion of contract
(1) The display of the bookable times on the booking platform does not constitute a binding offer from the club, but rather an invitation to the user to make an offer.
(2) The user selects the date, start time, duration, number of players playing and, if applicable, the racket rental company and provides his or her contact details. Before sending the booking, all details including the total price will be displayed for checking; He can correct input errors there using the usual keyboard and mouse functions.
(3) By pressing the button “book with payment” the user makes a binding offer to conclude a user agreement.
(4) The contract is concluded as soon as the user receives the booking confirmation from the club by email. When paying by credit card or PayPal, this occurs immediately after successful payment authorization.
(5) When paying by bank transfer The contract is only concluded upon receipt of the booking confirmation after full payment has been received. Until then is the desired periodnot reserved and can be assigned elsewhere.
(6) The contract text is saved by the association. The user receives the contract data in text form with the booking confirmation.
(7) The contract language is German.
§ 3 Booking times and scope of booking
(1) The space can be booked daily between 6:00 a.m. and 10:00 p.m., on Sundays and public holidays from 7:00 a.m.
(2) The minimum booking duration is 60 minutes, the maximum booking duration is 120 minutes. Bookings are made in units of 30 minutes.
(3) Bookings are possible up to 14 days in advance.
(4) A booking entitles you to use the space exclusively during the booked period. The pitch must be left cleared at the end of the booking period so that subsequent bookings can begin on time.
(5) Passing on or subletting the booking to third parties is not permitted.
§ 4 Prices and sales tax
(1) The entire space is always booked. The price of the place is always calculated for four ends of the game, regardless of how many people are actually playing.
(2) The following final prices apply per player and hour:

(3) For bookings of 90 or 120 minutes, the hourly rate will be calculated pro rata.
(4) Calculation examples:
- Four members, 60 minutes: 4 × €4.00 = 16,00 €
- Four non-members, 60 minutes: 4 × €7.00 = 28,00 €
- Two members and two non-members, 90 minutes: (2 × €4.00 + 2 × €7.00) × 1.5 = 33,00 €
(5) All prices mentioned are final prices and include statutory sales tax. The reduced tax rate of 7% is levied on the portion allocated to members of the padel division, and the standard tax rate of 19% is levied on the portion for non-members. For mixed bookings, the booking confirmation shows the tax rates separately.
(6) The information provided by the user regarding the number of players and the membership status is decisive for the price calculation. The user guarantees the accuracy of this information. If it turns out that the reduced member price was wrongly claimed, the association is entitled to demand the difference to the price for non-members.
§ 5 Payment
(1) Payment can be made either by credit card, PayPal or bank transfer.
(2) Payment is due immediately upon completion of the booking process.
(3) When paying by credit card or PayPal, processing is carried out by the respective payment service provider. Their conditions also apply.
(4) When paying by bank transfer, the invoice amount must be transferred to the club account specified in the booking confirmation, stating the booking number. The desired period will only be bindingly reserved after full payment has been received (§ 2 Para. 5).
§ 6 Cancellation and no-show
(1) The user can cancel a booking using the cancellation function on the booking platform.
(2) The following conditions apply:

(3) If the association can allocate the freed-up period to someone else, the amount obtained for this will be credited towards the claim in accordance with paragraph 2.
(4) The user is permitted to prove that the association suffered no damage or significantly less damage. In this case, the amount to be paid will be reduced accordingly.
(5) The regulations in this paragraph do not apply in the cases of § 11 (cancellation by the association).
§ 7 No right of withdrawal
There is a right of withdrawal not.
According to Section 312g Paragraph 2 No. 9 BGB, there is no right of withdrawal for contracts for the provision of services in connection with leisure activities if the contract stipulates a specific date or period for the provision. This is the case when booking a padel court at a specific time.
The cancellation options according to Section 6 of these General Terms and Conditions remain unaffected.
§ 8 Access and access code
(1) Access to the pitch is via a key safe in which the pitch key is located.
(2) The access code will be sent to the user in good time before the booked time to the email address provided when booking. The code is changed regularly.
(3) The access code is personal and confidential. Passing it on to people who do not belong to the booked play group is prohibited. The user is liable for damage caused by unauthorized disclosure.
(4) The user is obliged to immediately return the key to the key safe after the end of use and to lock it properly.
(5) If the key is lost, the user is obliged to inform the association immediately. The user bears the costs for the replacement and, if necessary, for any necessary replacement of the locking system if he is responsible for the loss.
§ 9 Site regulations
(1) The user and the people he brings with him must behave in such a way that the system, equipment and other people are not endangered or damaged.
(2) The following rules apply in particular:
Footwear
- The pitch may only be entered with suitable sports footwear. Indoor, tennis or padel shoes with smooth or low-profile soles are permitted. The soles must not stain as this will permanently damage the artificial turf surface.
- Street shoes and shoes with knobs, studs or spikes are not permitted.
- Footwear must be cleaned of soil, sand and stones before entering the site. Foreign bodies damage the surface and the sand bedding.
On the pitch
- Glass containers of any kind are prohibited.
- Drinks and food may not be taken onto the playing area.
- Smoking is prohibited on the entire playing area.
- Bringing dogs and other animals onto the facility is not permitted.
Handling the system
- The glass surfaces of the court are designed solely to keep the ball in play. They are not designed for impact with people and can break under appropriate force. Do not support, lean on or jump on the glass surfaces.
- Climbing on fences, nets or glass walls is prohibited.
- Before the game begins, the condition of the pitch must be briefly checked and loose foreign objects must be removed.
After use
- The place must be left clean and in good condition. Any trash you bring with you must be taken back with you.
- The lighting must be switched off at the end of use.
- Gates and entrances must be closed and the facility must be locked. The key must be returned in accordance with Section 8 Paragraph 4.

- Particularly in the early morning and late evening hours, avoidable noise pollution to the neighborhood should be avoided.
(3) In the event of wetness, frost, snow or other weather-related impairments, the user is responsible for checking whether safe use is possible. If the space is clearly unsuitable for use, please refrain from using it.
(4) The user is obliged to immediately report any damage or defects to the system to the association at kontakt@tsv-battenberg-padel.de.
(5) The association exercises house rights. In the event of significant or repeated violations of these terms and conditions or the site rules, the club can expel the user from the facility and exclude them from future bookings. In this case there is no entitlement to reimbursement.
§ 10 Racket rental
(1) Rackets can be rented for the fee stated in § 4.
(2) The clubs are made available to the user via the club locker on the facility. The user removes the number of clubs he has booked and returns them to the same location, cleaned, immediately after the end of use. The cupboard must then be closed again.
(3) The user must check the rackets for obvious defects before use and report these to kontakt@tsv-battenberg-padel.de before use.
(4) The clubs must be treated with care and returned in the condition in which they were received.
(5) If a racket is damaged or not returned, the user must reimburse the club for the current value of the racket if he is responsible for the damage or loss. Normal wear and tear due to intended use is not taken into account. The user is permitted to prove that no or lesser damage occurred.
§ 11 Cancellation by the club, force majeure
(1) If use is not possible or unreasonable due to severe weather, storms, thunderstorms, heavy rain, frost, snow or other weather-related circumstances, the club can also issue a weather permit for the affected bookings at short notice.
(2) The club can also close the course for important reasons, in particular for repairs and maintenance work as well as for club events and tournaments. Bookings that have already been confirmed will be excluded from this if possible; If this is not possible, the club can cancel the affected bookings.
(3) If the weather is released in accordance with paragraph 1, the user receives a personal link and can either rebook to a free date free of charge or cancel the booking. If a booking has already been paid for, the amount paid will be refunded in the event of cancellation, minus a processing fee of €2.00. A transfer booking that has not yet been paid will be canceled free of charge. The weather release is valid until two hours after the booked start of the game.
(4) The board of the padel division decides on the weather release. Information with the personal link will be sent as early as possible by email to the address provided when booking. If weather conditions occur at short notice, the release can also take place immediately before the booked period.
(5) In the event of a cancellation in accordance with paragraph 2, any amount already paid will be fully refunded. There is no processing fee in this case.
(6) The user has no further claims, in particular for reimbursement of travel costs or other expenses, unless the association is at fault. § 13 remains unaffected.
§ 12 Minors
(1) Bookings may only be made by persons who are of legal age and have unlimited legal capacity be made.
(2) Minors from the age of maturity 14th year of age are allowed to use the space without being accompanied by an adult, provided the legal guardian agrees to this.
(3) Children under the age of 14 may only enter and use the facility when accompanied by an adult.
(4) The booking user is responsible for supervising minors brought along and ensuring that they comply with the site rules in accordance with Section 9.
§ 13 Liability
(1) The association is liable unlimited
- for damages resulting from injury to life, body or health that are based on a negligent or intentional breach of duty by the association, its legal representatives or vicarious agents,
- for other damages that are based on an intentional or grossly negligent breach of duty by the association, its legal representatives or vicarious agents,
- to the extent of any guarantee provided and
- for claims under the Product Liability Act.
(2) In the case of minor negligent injury essential contractual obligations The club's liability is limited to the amount of damage that was foreseeable at the time the contract was concluded and was typical for the contract. Essential contractual obligations are those obligations whose fulfillment is essential for the proper execution of the contract and on whose compliance the user can regularly rely.
(3) Otherwise, the association's liability is excluded.
(4) The above limitations of liability also apply to the benefit of the association's legal representatives, employees and vicarious agents.
(5) Padel is a sport with risks of injury typical of the sport. The user takes part in the game at his own sporting risk. Paragraphs 1 to 4 above remain unaffected.
(6) The association assumes no custody or liability for items, valuables and vehicles brought along, unless otherwise stated in paragraphs 1 and 2.
(7) The user is liable for damage to the system and the equipment that he or the people he brings with him culpably cause, in accordance with the statutory provisions.
§ 14 Video surveillance
(1) The association uses video surveillance to protect against theft, burglary and damage to property as well as to prevent and investigate unauthorized access to the facility.
(2) The image section is narrow on the Key safe and its immediate vicinity limited. Only the hands of the operator are regularly recorded. The entrance area, the access routes and the playing area will benot monitored. The detection of faces does not take place specifically, but cannot be completely ruled out in individual cases.
(3) An audio recording is found not instead of.
(4) The recordings will be automatically deleted after 48 hours at the latest, unless they are needed in individual cases to track a specific incident or to assert legal claims.
(5) Only the board of the padel division has access to the recordings.
(6) The legal basis for processing is Article 6 (1) (f) GDPR. The legitimate interest of the association lies in the protection of its property as well as in the investigation of criminal offenses and damage to property at the facility.
(7) The recordings will not be used to monitor compliance with these Terms and Conditions, to check the number of players playing, to monitor usage times or to monitor behavior or performance.
(8) Video surveillance is also indicated by a sign in front of the monitored area. Detailed information on processing and the rights of the data subjects can be found in the data protection declaration at https://tsv-battenberg-padel.de/datenschutz.
§ 15 Data protection
The association processes the user's personal data exclusively in accordance with the applicable data protection regulations. Details on the type, scope, purpose and legal basis of the processing as well as the user's rights can be found in the data protection declaration at https://tsv-battenberg-padel.de/datenschutz.
§ 16 Final provisions
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection regulations of the country in which the user has his or her habitual residence remain unaffected.
(2) The statutory places of jurisdiction apply to lawsuits.
(3) The association is neither obliged nor willing to take part in a dispute resolution procedure before a consumer arbitration board.
(4) Should a provision of these General Terms and Conditions be or become invalid, the effectiveness of the remaining provisions remains unaffected. The statutory provisions shall replace the invalid provision.
